Introduction to the L-1 Visa Program

The L-1 visa is a non-immigrant visa that functions similarly to a work permit, authorizing the holder to legally reside and work in the United States without needing any additional work permits.
The visa holder has the right to legally reside and work in the United States without needing any additional work permits. This US work visa is valid for up to 7 years.
The L-1A visa program is designed for senior managers of companies who wish to expand and develop their business, invest, and establish a long-term presence in the United States.

The L-1 visa is divided into two main categories, each for different applicants and purposes:

L-1A Visa — For managers and senior executives who are intracompany transferees working at a related US company. Maximum validity up to 7 years.
L-1B Visa — For employees with specialized knowledge about the company's products, services or procedures. Maximum validity 5 years.

Program Conditions

For Principal Applicant

Applicant must be 18 years of age or older;
*While there is no specific maximum age requirement, the applicant's age must be suitable for managing a business in the US until permanent residency is obtained;
Applicant must currently hold a senior management position at the parent company in the home country;
Applicant must have the competency and experience to assume a management position and operate a company in the US;
Applicant must meet security clearance and health requirements.

Conditions for L1-A Visa

  • Applicant must be the owner or senior manager/executive of a business in their home country.
  • Applicant owns more than 50% of the US company's capital.

Conditions for L1-B Visa

  • Applicant must possess specialized knowledge in a specific field within their home country company.
  • Must have more than 1 year of work experience at the home country company.
  • Must be transferred by the company to work at the US affiliate.

For Business

The home country company must have been operating for at least 2 years, be profitable, and have paid all corporate taxes.
The nature of the US and home country companies (business functions) does not need to be identical, but a qualifying relationship must be demonstrated (parent company, branch, subsidiary, or affiliate — collectively referred to as a qualifying organization).
The US company may be newly established or already operating, and must have a 5-year business and development plan to demonstrate the need for management transfer.
Both companies must have active offices.
Prove the company has the financial capacity to transfer personnel to the US.

Register for free profile assessment

Authorized to open a branch, representative office, or acquire a company and conduct business in any US state.
The applicant and dependents (spouse and children under 21) are permitted to enter and work in the US for the duration of the visa.
Spouses may apply for work authorization and work in the US in any occupation.
Children under 21 can attend public school for free and enjoy the high social benefits of US public schools, significantly reducing educational costs.
Access to English language assistance, social security card, health insurance, and other benefits depending on the state of residence.
The applicant may later apply for an EB-1C visa, which can be obtained a few years after establishing and operating the US business and meeting certain conditions.
